Hemp and the law, today
Law 242/2016 promotes industrial hemp: varieties certified in the European Union and THC within 0.2%, with a tolerance of up to 0.6%. However, Article 18 of the Security Decree (Decree-Law 48/2025, converted into Law 80/2025) bans the supply chain of flowers, even low-THC ones, and of their derivatives. The Constitutional Court will discuss it on 9 February 2027, and the Court of Justice of the European Union is examining a related case (C-716/25). Fibres, seeds and hurds remain fully legal uses.
